| Nel granted bail
January 09 2008 at 05:35PM
Gauteng Scorpions boss Gerrie Nel was granted bail of R10 000 in the Pretoria magistrate's court on Wednesday.
Magistrate Peet Johnson agreed to postpone the matter to January 14 on condition that Nel would not interfere in the investigation.
His lawyer Ian Small Smith, said: "The purpose of the short postponement is to allow the prosecution to go through the docket and then make a decision."
Nel appeared in the dock wearing khaki pants and a green shirt.
The Regional Head of the Directorate of Special Operations or the Scorpions was arrested at his Pretoria home in front of his wife and children around 9pm on Tuesday night by about 20 armed policemen.

He faces two charges - according to the charge sheet - of corruption and defeating the ends of justice.
Small Smith told reporters that he had an idea of what the charges were made up of - but he was not yet clear on specifics.
He said he was extremely proud of his client.
"He handled it very well and positively because he knows he's innocent."
Police also carried out a raid on Nel's house on Wednesday. Apparently nothing was taken.

| ShockAdvocate Mokotedi Mpshe, the acting National Director of Public Prosecutions, has expressed his shock and concern about the arrest. "The NPA wishes to express its serious concern about the process followed in this matter," it said in a statement after Nel's release. Mpshe said the allegations against Nel first came to light in September last year. "Several different prosecutors were approached and were requested to apply for an arrest warrant for advocate Nel. They all declined on the basis that there was not sufficient evidence in the docket," Mpshe said in the statement-----sapa "Those whom the gods wish to destroy they first make mad." ---Euripides (480-406BC the last of the three great tragedians of classical Athens) | |

| Subject: NPA urged to stop acting like a corner shop - De Lille Thu Jan 10, 2008 10:29 pm | |
| January 10 2008 at 08:27PM
The National Prosecuting Authority (NPA) needs to clarify whether or not it will prosecute national police commissioner Jackie Selebi, Independent Democrats president Patricia de Lille said on Thursday.
"The NPA is damaging their own image by waiting for political instructions and they must stop behaving like a corner shop," said De Lille.
De Lille said the ID had received a response from the NPA regarding the status of its case against Selebi.
"Although the letter states that the NPA has taken a decision on whether or not to prosecute Selebi and also mentions the fact that the Commissioner has served an urgent interdict on the NPA, we still do not know what the NPA decision is," said De Lille.
? She said the NPA needed to clarify its position and if it had already made a decision, it should inform the public.
"If they have a good reason for not letting the public know, then they must tell us what that reason is," said De Lille. - Sapa |

The National Prosecuting Authority (NPA) made a "concerted effort" to undermine investigations into Scorpions boss Gerrie Nel and prevent his prosecution, Gauteng police said on Thursday.
In a statement, Superintendent Lungelo Dlamini said prosecutors had refused to look at evidence presented to them in September which implicated Nel in criminal activity and requested them to apply for a warrant of arrest.
Nel was arrested at his home on Tuesday night on charges including corruption and defeating the administration of justice.
"The prosecutors who were approached refused to even look at the evidence as soon as Nel's name was mentioned.
"The reasons cited ranged from the fact that Nel is a senior member of the NPA to their involvement being against NPA policy," said Dlamini.
He said the NPA had been approached to seek their involvement and co-operation.
Dlamini said investigators found the situation unacceptable and more evidence was gathered.
"[Further] evidence was gathered which indicated that there was a concerted effort from within the NPA to undermine and derail the investigation in order to prevent prosecution," he said.
Dlamini said police disputed an NPA media statement on Wednesday by acting National Director of Public Prosecutions Mokotedi Mpshe.
In the statement Mpshe said several different prosecutors were approached and were requested to apply for an arrest warrant for Nel.
"They all declined on the basis that there was not sufficient evidence in the docket," Mpshe said.
Dlamini said: "The SAPS [South African Police Service] disputes this."
He said the refusal was the subject of a separate investigation.
"The SAPS therefore had no other recourse than to obtain a warrant of arrest from an independent magistrate and to proceed," he said.
Dlamini said Mpshe had been personally presented with evidence to support the police's version of facts on Wednesday.
"The said tangible evidence explained why liaison between the SAPS investigation team and Advocate [Sibongile] Mzinyathi - appointed by Mpshe to assist - had been discontinued.
"The media statement which was later issued by the NPA was certainly not informed by the evidence presented," he said.
Dlamini said the SAPS was "convinced" it had a prima facie case against Nel.
"[The SAPS] finds it strange that, in certain quarters, the motive behind the investigation and arrest is being questioned.
"Surely no law-abiding citizen would prefer the SAPS to ignore allegations of criminal acts just because the accused is a member of the NPA responsible for various investigations."
NPA spokesperson Tlali Tlali on Thursday said the prosecuting body stood "100 percent" behind its earlier statement.
"We are not interrogating or questioning the merits. If the police have carried out a legitimate investigation and if what is contained in the docket will be able to survive the test in court, we are saying well and good.
"It is not for us to shield, to harbour or to protect anyone who has committed an act of crime," said Tlali.
He said the it could not be argued that there had been any reluctance on the part of the NPA.
"Every agreement that we made, there is correspondence to that effect. We are in a position to produce [these] communications," Tlali said.
Nel appeared in the Pretoria Magistrate's Court on Wednesday and was granted R10 000 bail.
He is expected to appear in court again on Monday. - Sapa |

| Pressure mounts for Selebi's suspension | January 11 2008 at 08:02PM |
| Opposition parties have called for the immediate suspension of National Police Commissioner, Jackie Selebi, in light of his failure to prevent the NPA from prosecuting him. Selebi's urgent application was denied in the Pretoria High Court on Thursday. Judge Nico Coetzee said the application bore no merit and it was struck off the roll. He added that the administration of justice would be brought into disrepute if Selebi was not prosecuted. The Freedom Front Plus (FF Plus) came out in support of the court's decision, saying that it was a "significant victory for the Rule of Law". FF Plus justice spokesman Frik van Heerden said it was an "irony" that Selebi "dared" to approach the court to prevent his own arrest and prosecution. This, only a few days after a task force of more than 20 police officers arrested "respected" Scorpions prosecutor Gerrie Nel. The African Christian Democratic Party (ACDP) and the Democratic Alliance (DA) called on President Thabo Mbeki to suspend Selebi immediately. "This action is not only crucial in light of the high rate of crime in South Africa and the implications for SAPS morale; the matter of Selebi's suspension and fitness is of world interest," said ACDP spokesperson Kenneth Meshoe. - Quote :
"It is an embarrassment with the commissioner being the present head of Interpol and with the world spotlight being upon security in light of 2010," he said. ..... and how ... The DA said silence on the part of both the president and minister of safety and security in relation to Selebi's application had been "deafening". DA spokesperson Dianne Kohler Barnard said: "The NPA's refusal to bow down before political heavyweights - Quote :
- restores the public's faith in the
impartiality of the criminal justice system." - Sapa .......> not eggsagly as of now .... but ..dig , boys ... dig ... |

Wonderlik. 2008 gaan swaar wees vir die ANC. Maar nie vir die land nie. |
